Plain English Summary

Vloggi stores customer data in Australia by default. For enterprise customers, we offer additional hosting options in the European Union, Switzerland, and the United States to support data residency and regulatory requirements.

Where a specific region is selected, your data is primarily stored and processed in that region. However, limited access or processing may occur outside the region for support, security, or operational reasons. Regional hosting supports compliance, but customers remain responsible for meeting their own legal obligations.

Multi-Regional Data Hosting Policy

1. Overview

This Multi-Regional Data Hosting Policy (“Policy”) describes how and where Customer Data is hosted and processed by Vloggi Pty Ltd (“Vloggi”) for eligible customers.

This Policy forms part of the Vloggi Platform Use Agreement  (“Terms”). In the event of any conflict, this Policy prevails.

Vloggi provides region-based data hosting options designed to support customer requirements relating to data residency, sovereignty, and regulatory compliance.

2. Data Hosting Regions

Vloggi operates a multi-region hosting model. Customer Data is hosted within one of the following Regions:

3. Service Tiers and Regional Availability

3.1 Standard Service (Default Hosting)

For standard self-service customers:

  • Customer Data is hosted in Vloggi’s default region (Australia)

  • This applies to all customers who have not selected or contracted a specific Region

  • Standard service does not currently include customer-controlled data residency selection

3.2 Enterprise Service (Regional Hosting Options)

Regional data hosting options are available to enterprise customers under a commercial agreement.

Enterprise customers may:

  • Select a specific Region (EU, CH, US, or APAC)

  • Contractually require Customer Data to be primarily hosted within that Region

  • Receive supporting documentation for compliance, procurement, and regulatory requirements

Region selection is configured at the account or tenant level and remains fixed unless otherwise agreed.

3.3 Future Regional Controls

Vloggi is developing capabilities to allow customers to directly select and manage their preferred data hosting Region.

These capabilities are expected to include:

  • Region selection during account creation

  • Region migration tools (subject to technical and contractual constraints)

  • Region-specific service configurations

Availability of these features may vary by plan and Region.

4. Regional Hosting Commitment

4.1 Applicability

The Regions described below represent Vloggi’s available data hosting capabilities.

Availability of specific Regions depends on the customer’s service tier and commercial agreement (see Section 3).

4.2 Primary Hosting Location

For customers with regional hosting enabled:

  • Customer Data is hosted in a Region determined by:

    • Customer location (IP and/or declared country), or

    • Explicit Region selection at account creation or contract stage

Once assigned, Customer Data is primarily stored and processed within that Region.

4.3 European Union (EU Region)

For customers hosted in the European Union, the European Economic Area or the United Kingdom:

  • Customer Data is primarily stored and processed within EU jurisdictions

  • Data is handled in accordance with data protection practices aligned with the General Data Protection Regulation (GDPR) Regulation (EU) 2016/679 

  • Infrastructure is selected to support EU data residency and sovereignty requirements

4.4 Switzerland (CH Region)

For customers requiring Swiss data residency:

  • Customer Data is primarily stored and processed within Switzerland

  • Infrastructure is selected to align with Swiss data protection laws and banking-grade confidentiality expectations

  • This Region is intended for highly regulated use cases, including financial services and sensitive enterprise deployments

4.5 Australia (APAC Region)

For Asia-Pacific customers:

  • Customer Data is primarily hosted within Australia

  • Infrastructure aligns with Australian data protection and security standards

4.6 United States (US Region)

For customers in the Americas:

  • Customer Data is primarily hosted within the United States

  • Infrastructure aligns with US operational and enterprise requirements

4.7 Infrastructure Model

Vloggi utilises a combination of cloud infrastructure providers within each Region.

Infrastructure is selected based on:

  • Data sovereignty requirements

  • Security and compliance standards

  • Performance and reliability

Vloggi may change or add infrastructure providers within a Region without affecting the Region-based hosting commitment.

5. Definitions

For the purposes of this Policy:

  • Customer Data: Any data submitted, uploaded, or processed through the Services

  • Hosting: Storage, replication, backup, or persistence of Customer Data

  • Processing: Any operation performed on data (including access, analysis, or transmission)

  • Region: The primary geographic location where Customer Data is hosted

  • Exclusions: Specific scenarios where processing may occur outside the Region (see Section 5)

Capitalised terms not defined here have the meaning given in the Terms.

6. Exclusions (Cross-Region Processing)

While Customer Data is primarily hosted within a Region, limited processing may occur outside that Region under controlled circumstances:

6.1 Customer Support

Authorised Vloggi personnel may access Customer Data from outside the Region solely to provide technical support.

6.2 Security and Compliance

Customer Data may be processed outside the Region to:

  • Detect or investigate security incidents

  • Enforce platform policies or legal obligations

6.3 User Access

Customer Data may be accessed or transferred outside the Region when:

  • Users access the platform from another geographic location

  • Content is intentionally shared, exported, or distributed globally

6.4 Sub-processors

Vloggi may engage approved sub-processors operating in multiple jurisdictions. Customer Data may be processed where those sub-processors operate, subject to:

  • Contractual safeguards

  • Data protection agreements

  • Applicable legal frameworks (e.g. Standard Contractual Clauses where required)

7. Scope Limitations

This Policy does not apply to:

  • Customer Data hosted on customer-managed infrastructure

  • Beta or experimental features

  • Third-party services or integrations not controlled by Vloggi

8. Hosting Disclaimer

While Vloggi provides Region-based hosting controls:

  • Not all processing is guaranteed to remain exclusively within a single Region

  • Cross-region access may occur under the conditions outlined in Section 5

  • Regional hosting alone does not guarantee compliance with all regulatory frameworks

Customers remain responsible for:

  • Determining their regulatory obligations

  • Ensuring compliance with applicable laws

9. Regulatory Positioning

Vloggi’s regional hosting model is designed to support, but not replace, customer compliance obligations under frameworks including:

  • GDPR (European Union and United Kingdom)

  • Swiss Federal Act on Data Protection (FADP)

  • Australian Privacy Act

  • Applicable US data protection laws including the California Consumer Protection Act

Customers should conduct their own legal assessment of suitability.

11. Future Regions and Migration

Vloggi may:

  • Introduce additional Regions

  • Offer Region selection or migration options

  • Provide region-specific service tiers

12. Policy Updates

Vloggi may update this Policy at any time.

  • Material changes will be reflected in the “Last Updated” date

  • Customers may be notified via email or platform notification

Continued use of the Services constitutes acceptance of the updated Policy.
